Licensing

Legal review required. Both the EULA and third-party attribution section are working drafts and have not yet been reviewed by a qualified attorney. They must be reviewed before public launch. Additionally, confirm final aggregator vendor terms (Terra API or equivalent) once vendor selection is finalized — attribution obligations may vary by vendor.

End-User License Agreement (EULA)

This End-User License Agreement (“EULA”) governs your use of the Essomio mobile application (“App”). By installing or using the App, you agree to this EULA.

Grant of license

Essomio grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial health tracking purposes.

Restrictions

Apple App Store / Google Play additional terms

If you downloaded the App from the Apple App Store, Apple Inc. is a third-party beneficiary of this EULA and may enforce it against you. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product liability claims, consumer protection claims, intellectual property claims, or any other claim relating to the App.

If you downloaded the App from Google Play, Google LLC is a third-party beneficiary of this EULA to the extent required by Google Play's Developer Distribution Agreement.

Termination

This license is effective until terminated. It terminates automatically if you breach any term of this EULA. On termination, you must cease all use of the App and delete all copies.

Third-party data source attributions

Essomio uses data from the following third-party sources. Use of these sources is subject to their respective terms and policies.

USDA FoodData Central (FDC)
Nutritional data is sourced from the U.S. Department of Agriculture's FoodData Central database, which provides food composition data including Foundation Foods, SR Legacy, and the FNDDS (Food and Nutrient Database for Dietary Studies). FDC data is in the public domain. For more information: fdc.nal.usda.gov
Apple HealthKit
Essomio integrates with Apple HealthKit on iOS to read and write health data with your permission. Use of HealthKit data is governed by Apple's HealthKit Framework License Agreement and Apple's App Store Review Guidelines. Essomio's use of HealthKit data complies with Apple's restrictions: HealthKit data is used only for health and fitness purposes, never for advertising or data mining.
Google Health Connect
Essomio integrates with Google Health Connect on Android to read and write health data with your permission. Use of Health Connect data is governed by Google's Health Connect Permissions Policy. Essomio's use complies with Google's restrictions: Health Connect data is used only for health and fitness purposes, never for advertising or data mining.
Third-party wearable connectors (Premium — vendor TBD)
Premium subscribers may connect Fitbit, Garmin, Oura, Whoop, and other wearable platforms via a cloud-aggregator API (vendor selection pending). Connecting these platforms is subject to each platform's own terms of service and OAuth scope disclosures. Attribution and licensing terms for the specific aggregator vendor will be added here once the vendor is selected and contracted.

Open-source licenses

Essomio is built using a number of open-source software packages. A full list of open-source licenses for packages included in the distributed app will be published here before public launch, per the attribution requirements of the applicable licenses (MIT, Apache 2.0, BSD, etc.).
