Terms of Service

Legal review required. These Terms of Service are a working draft and have not yet been reviewed by a qualified attorney. They must be reviewed and approved before Essomio is made publicly available.

By downloading, installing, or using the Essomio application or visiting essomio.com (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. The Service

Essomio provides personal health tracking, data aggregation, and analysis tools for iOS, Android, and web. It is a personal productivity tool, not a medical device, and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare professional for medical advice.

2. Accounts

You must create an account to use Essomio. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@essomio.com if you suspect unauthorized access.

You must be at least 13 years old (or 16 where required by local law) to create an account. Accounts are for individual use; you may not share your account.

3. Free and Premium tiers

Essomio offers a free tier (“Track”) and a paid Premium subscription (“Understand”). The features available on each tier are described on the Pricing page. We reserve the right to modify tier features with reasonable notice.

Premium subscriptions are billed through the Apple App Store or Google Play Store according to their respective terms. Cancellation, refund, and trial policies are governed by the store through which you subscribed.

4. Your data

Your health data belongs to you. We do not claim ownership of any data you log or sync. You may export your data at any time and delete your account at any time. See the Privacy Policy for full details on how your data is handled.

5. Acceptable use

You agree not to:

Reverse-engineer, decompile, or attempt to extract source code from the app
Use the Service to harm others or for any unlawful purpose
Attempt to gain unauthorized access to other accounts or systems
Upload malicious content or interfere with the Service's operation
Resell or sublicense access to the Service

6. Third-party integrations

Connecting third-party services (Apple Health, Google Health Connect, Fitbit, Garmin, Oura, Whoop, etc.) to Essomio is subject to those services' own terms. We are not responsible for third-party data, accuracy, or service availability.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE. ESSOMIO IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESSOMIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Changes to the Service or Terms

We may update these Terms or the Service at any time. Material changes will be notified by email and in-app notice. Continued use after notice constitutes acceptance.

10. Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms. On termination, your data will be deleted per the Privacy Policy.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Essomio is incorporated, without regard to conflict-of-law principles. This will be updated with the specific jurisdiction before public launch.
